VALID versus COMPLIANT
A couple of months ago the PPRA (Property Practitioners Regulatory Authority) announced that, to renew FFC’s in 2025, a compliant BEE certificate would be needed, not just valid.
Jan Le Roux, CE of REBOSA (Real Estate Business Owners of South Africa), presented their case in a letter to the PPRA chairperson, Dr Steven Ngubeni. He stated that the PPRA’s “interpretation is not legally sound and will bear no positive results and will seriously harm the industry.”
Now months of negotiations have borne fruit. Dr Ngubeni announced that “After careful consideration and consultation with our legal advisers, we have resolved that the term valid in the context of BEE certificates does not imply compliant. We will now require industry participants to submit BEE certificates that are valid.”
This implies that a VALID BEE certificate must be obtained, but with no minimum BEE scores. It needn’t be compliant.
According to Le Roux, REBOSA are pleased with the decision of the PPRA, and then also stressed that enforcing compliant BEE certificates would not be the way to effect transformation within the industry.
